Workers Compensation

  Our workers compensation committee is here to help Local 4320 members who are injured on the job. Do not allow your employer to file your claim. They can not properly represent both sides of the table.

 

If you suffer an on the job injury please call 614-236-8064 and we will put you in contact with a member of the committee. They will file your claim and represent you in the hearing.

SPECIAL NOTICE - PLEASE READ

On July 12, 2004 Governor Taft signed a bill into law making it possible for employers to drug test you following a work related injury  (Workers compensation claim) This law became effective on Oct. 13, 2004


IT STATES:

- IF YOU EITHER FAIL A DRUG TEST OF REFUSE TO TAKE ONE, IT IS PRESUMED THAT THE CAUSE OF THE INJURY IS DUE TO SUBSTANCE ABUSE. IT THEN BECOMES THE EMPLOYEE'S RESPONSIBILITY TO PROVE THAT THE ILLEGAL SUBSTANCE WAS NOT WHAT CAUSED THE INJURY.

-A TEST CAN BE REQUESTED IN ANY OF THREE DIFFERENT WAYS.

- THE EMPLOYER HAS "REASONABLE CAUSE"

- A LAW ENFORCEMENT OFFICER REQUESTS IT.

- A LICENSED PHYSICIAN, THAT IS NOT EMPLOYED BY THE COMPANY, REQUESTS IT.

ADDITIONALLY, THE COMPANY DRUG TEST POLICY APPLIES.
